Toy Room Club Malta

Ticketing, Refund, Entry and Event Terms and Conditions

 

These Terms and Conditions apply to all tickets purchased for events organised or hosted by Toy Room Club Malta, whether purchased directly through Toy Room Club Malta or through an authorised ticketing provider.

 

By purchasing, accepting, using or attempting to use a ticket, the ticket holder acknowledges that they have read, understood and agreed to these Terms and Conditions.

 

 1.⁠ ⁠Ticket Purchases

 

All ticket purchases are final and non-refundable, except where a refund is required by applicable law or expressly provided for under these Terms and Conditions.

 

Tickets are valid only for the event, event concept, date and ticket category stated on the ticket.

 

It is the purchaser’s responsibility to check all ticket details before completing the purchase, including the event name, date, time, ticket category and quantity.

 

Purchasing a ticket online does not automatically provide the purchaser with a right to cancel the ticket or request a refund.

 

Where one person purchases tickets on behalf of other guests, the purchaser is responsible for informing all ticket holders of these Terms and Conditions.

 

 2.⁠ ⁠Non-Refundable Tickets

 

Refunds will not be issued due to personal circumstances, including but not limited to:

 

illness or injury;

travel delays or cancellations;

transport problems;

work or personal commitments;

missed entry;

late arrival;

failure to attend;

a change of plans;

purchasing the wrong event, date or ticket category;

failure to provide valid identification;

failure to satisfy the venue’s age or entry requirements;

refusal of admission for security, safety or behavioural reasons;

removal from the venue;

loss, theft or non-use of a ticket;

dissatisfaction with an artist, performer, programme change or other non-material event change.

 

No refund will be issued where a ticket holder voluntarily decides not to attend the event.

 

Booking fees, transaction fees, administration fees and other third-party charges are non-refundable, except where otherwise required by applicable law.

 

 3.⁠ ⁠Ticket Exchanges

 

Unused tickets may, at the sole discretion of Toy Room Club Malta, be exchanged for another date of the same recurring event concept.

 

For example, a ticket purchased for a Glow Party may potentially be exchanged for a future Glow Party, subject to availability and approval.

 

The following conditions apply:

 

The exchange request must be made before the original event takes place.

The original ticket must not have been scanned, used, cancelled or previously exchanged.

The requested future event must be the same event concept.

Exchanges between different event concepts are not permitted.

Approval is subject to availability and is not guaranteed.

Any difference in ticket price or applicable administration charge must be paid by the ticket holder.

Tickets cannot be exchanged after the original event has taken place.

 

Toy Room Club Malta reserves the right to refuse an exchange request without being required to provide an alternative date or refund.

 

 4.⁠ ⁠Ticket Validity

 

A valid ticket must be presented to gain admission to the event.

 

Removing, altering, duplicating, copying, modifying or tampering with any part of a ticket or QR code may invalidate the ticket.

 

Each ticket permits one admission only. Where several copies of the same ticket exist, only the first valid ticket scanned will be accepted.

 

Toy Room Club Malta is not responsible for tickets obtained through unauthorised sellers, unofficial resale platforms or third parties.

 

Tickets purchased from an unauthorised source may be invalid, and admission may be refused without a refund.

 

The ticket holder is responsible for keeping the ticket and its QR code secure. Tickets should not be shared publicly or posted on social media.

 

 5.⁠ ⁠Ticket Resale and Transfer

 

Tickets may not be resold for commercial gain.

 

Where Toy Room Club Malta reasonably believes that a ticket has been resold for commercial gain, fraudulently obtained, duplicated or otherwise misused, the ticket may be cancelled without notice.

 

The holder of an invalidated ticket may be refused admission without a refund.

 

Any permitted name change or ticket transfer remains subject to the procedures and conditions of Toy Room Club Malta or the authorised ticketing provider.

 

 6.⁠ ⁠Event Cancellation

 

Where an event is cancelled by Toy Room Club Malta and is not rescheduled, ticket holders will be contacted regarding the available options.

 

Depending on the circumstances and applicable legal requirements, these options may include:

 

transferring the ticket to another event;

receiving ticket credit;

exchanging the ticket for another date; or

receiving a refund of the eligible ticket value.

 

Unless otherwise required by law, booking fees, transaction fees, delivery fees and administration fees are non-refundable.

 

Refunds will be processed only through the original payment method or authorised ticketing provider.

 

Toy Room Club Malta will not be responsible for any additional expenses incurred by the ticket holder, including travel, accommodation, transport, meals, loss of earnings or other associated costs.

 

 7.⁠ ⁠Postponed or Rescheduled Events

 

If an event is postponed or rescheduled, existing tickets will normally remain valid for the replacement date unless otherwise communicated.

 

Ticket holders will be informed of any available options through the contact details used when purchasing the ticket.

 

A change of event date does not make Toy Room Club Malta responsible for travel, accommodation, transport or other costs incurred by the ticket holder.

 

Where a refund or exchange is legally required or expressly offered, the ticket holder must submit the request within the deadline communicated by Toy Room Club Malta or the authorised ticketing provider.

 

 8.⁠ ⁠Changes to the Event

 

Toy Room Club Malta reserves the right, where reasonably necessary, to:

 

add, remove or substitute artists, DJs, performers or entertainers;

change the running order or advertised programme;

change opening, performance or finishing times;

modify production elements, performances or entertainment;

change the use of particular areas within the venue;

adjust the venue layout, audience capacity or access arrangements;

introduce additional health, safety or security measures.

 

These changes may be made because of artist availability, instructions from authorities, operational requirements, safety considerations or circumstances beyond the Organiser’s reasonable control.

 

Non-material changes to an artist line-up, running order, programme, performance time, production, venue layout or entertainment content will not automatically entitle the ticket holder to a refund.

 

Nothing in this section limits any mandatory rights the ticket holder may have where a material change occurs.

 

 9.⁠ ⁠Admission Age and Identification

 

Entry to Toy Room Club Malta is strictly limited to guests aged 17 years and over.

 

Valid physical identification may be requested upon entry and at any time while inside the venue.

 

Acceptable identification may include a valid:

 

national identity card;

passport;

driving licence; or

other government-issued photographic identification approved by management.

 

Photographs, screenshots, photocopies or expired documents may not be accepted.

 

Guests who cannot provide acceptable proof of age may be refused admission without a refund.

 

It is the ticket holder’s responsibility to confirm that they meet the age requirements before purchasing a ticket.

 

Alcohol will not be sold, served or supplied to anyone below the legally permitted age. Proof of age may be requested before alcohol is served. Maltese rules prohibit the sale of alcohol to persons under 17.

 

10.⁠ ⁠Right to Refuse Admission

 

Possession of a ticket does not remove the venue’s right to refuse admission where reasonably necessary for safety, security, legal or operational reasons.

 

Toy Room Club Malta reserves the right to refuse admission or remove any person who:

 

is unable to provide valid identification;

does not meet the minimum age requirement;

appears excessively intoxicated;

is behaving aggressively, abusively, dangerously or disruptively;

threatens or harasses guests, employees, performers or contractors;

fails to follow reasonable instructions from management or security;

refuses to undergo a lawful or reasonable security check;

is found with prohibited, illegal or dangerous items;

attempts to enter using an invalid, duplicated or fraudulent ticket;

breaches these Terms and Conditions;

breaches applicable law or venue policies;

presents a risk to their own safety or the safety of others.

 

Where admission is refused or a person is removed for any of these reasons, no refund or exchange will be issued.

 

11.⁠ ⁠Security Searches and Prohibited Items

 

For the safety of guests, performers and employees, Toy Room Club Malta may conduct reasonable security and bag searches before or during admission.

 

Guests who refuse to cooperate with a security search may be refused admission without a refund.

 

Illegal drugs, weapons, dangerous items and any other objects considered unsafe or unsuitable by management or security are prohibited.

 

Any prohibited or illegal items may be confiscated or reported to the relevant authorities where appropriate.

 

12.⁠ ⁠Late Arrival and Re-Entry

 

Ticket holders are responsible for arriving within the admission time stated on the ticket or event information.

 

Late admission is subject to venue capacity, security arrangements and management discretion.

 

Toy Room Club Malta does not guarantee admission to guests who arrive after the stated admission time, ticket cut-off time or venue closing time.

 

No refund will be issued because of late arrival or missed entry.

 

Leaving and re-entering the venue is subject to management approval and any applicable wristband, ticket or security procedures.

 

13.⁠ ⁠Personal Property

 

Guests are responsible for their own personal belongings while attending the event.

 

Toy Room Club Malta does not accept responsibility for the loss, theft or damage of personal property brought into the venue, except where such responsibility cannot legally be excluded.

 

Guests should not leave mobile phones, bags, wallets, clothing or other valuables unattended.

 

Any lost property handed to the venue will be managed according to the venue’s lost property procedures. Toy Room Club Malta does not guarantee that lost items will be recovered or returned.

 

14.⁠ ⁠Personal Safety and Conduct

 

Guests must behave responsibly and follow all reasonable instructions provided by management, employees, security personnel and emergency services.

 

Guests must not enter restricted areas or interfere with venue equipment, barriers, lighting, sound systems, performances or security arrangements.

 

Guests attend events with the understanding that nightclub environments may include:

 

loud music;

flashing or strobe lighting;

lasers;

smoke, haze or special effects;

crowded areas;

elevated sound levels;

live performances and moving production equipment.

 

Guests with medical conditions or sensitivities that may be affected by these elements should take appropriate precautions before attending.

 

15.⁠ ⁠Liability

 

Toy Room Club Malta will not be responsible for loss or damage that:

 

was not caused by a breach of its legal obligations;

was not reasonably foreseeable;

resulted from the actions or negligence of the ticket holder;

resulted from the actions of another guest or an independent third party;

resulted from circumstances outside the Organiser’s reasonable control;

relates to travel, accommodation, loss of earnings or other indirect expenses.

 

Toy Room Club Malta is not responsible for the independent acts or omissions of third-party promoters, performers, contractors, suppliers, ticket resellers or service providers, except where Toy Room Club Malta is legally responsible for those acts or omissions.

 

Nothing in these Terms and Conditions excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability or consumer right that cannot lawfully be excluded or limited.

 

16.⁠ ⁠Outdoor Events and Weather

 

Where all or part of an event is scheduled to take place outdoors, the event may proceed in changing weather conditions unless it is considered unsafe by the Organiser, venue management, safety officer or relevant authorities.

 

Guests are responsible for checking the weather and preparing appropriately.

 

Where an outdoor event proceeds as scheduled, no refund will be issued because of rain, wind, heat, cold or other weather conditions.

 

Where reasonably possible, Toy Room Club Malta may change the event layout, modify the programme, delay performances or move parts of the event to an alternative area.

 

Any cancellation or rescheduling caused by unsafe weather conditions will be handled in accordance with the cancellation and rescheduling sections of these Terms and Conditions.

 

17.⁠ ⁠Photography, Filming and Recording

 

Photography, video recording and audio recording may take place during the event for promotional, marketing, editorial, broadcast, documentation or security purposes.

 

Recordings may be produced by Toy Room Club Malta, event organisers, authorised photographers, videographers, sponsors, media partners or security providers.

 

Guests may appear incidentally in photographs or recordings taken in public areas of the venue. Information regarding the use of personal data will be handled in accordance with the applicable privacy notice and data-protection requirements.

 

Unauthorised professional or commercial photography, video recording, live-streaming or audio recording is prohibited unless prior written permission has been obtained from Toy Room Club Malta.

 

The use of professional cameras, detachable lenses, recording equipment, lighting equipment or similar devices may be restricted.

 

Personal mobile-phone recording remains subject to staff instructions and must not interfere with the event, performers, security or the enjoyment and privacy of other guests.

 

18.⁠ ⁠Force Majeure and Circumstances Beyond Reasonable Control

 

Toy Room Club Malta will not be responsible for delay, alteration, interruption or failure to hold an event where this results from circumstances outside its reasonable control.

 

Such circumstances may include:

 

severe weather;

natural disasters;

fire, flood or structural damage;

government or authority instructions;

public-health restrictions;

strikes or industrial action;

transport disruption;

power, technical or utility failure;

civil disturbance;

security threats;

performer illness or unavailability;

emergencies or other safety concerns.

 

Where such circumstances cause an event to be cancelled, postponed or materially altered, the available ticket options will be communicated in accordance with these Terms and Conditions and applicable law.

 

19.⁠ ⁠Authorised Ticketing Providers

 

Tickets may be processed or issued by an authorised third-party ticketing provider.

 

The ticketing provider’s terms, payment conditions and privacy policy may apply in addition to these Terms and Conditions.

 

Any refund, exchange or ticket amendment may need to be processed through the ticketing provider used for the original purchase.

 

Toy Room Club Malta is not responsible for tickets purchased through unauthorised agents, private sellers or unofficial resale platforms.

 

20.⁠ ⁠Applicable Law and Jurisdiction

 

These Terms and Conditions are governed by the laws of Malta.

 

Subject to any mandatory consumer rights concerning jurisdiction, the courts of Malta will have jurisdiction in relation to disputes arising from these Terms and Conditions, the purchase or use of a ticket, or attendance at an event.

 

Nothing in these Terms and Conditions affects any consumer rights that cannot lawfully be excluded, restricted or waived.

 

21.⁠ ⁠Severability

 

If any provision of these Terms and Conditions is found to be unlawful, invalid or unenforceable, that provision will be treated as modified or removed only to the extent necessary.

 

The remaining provisions will continue to apply.

 

22.⁠ ⁠Amendments

 

Toy Room Club Malta may update these Terms and Conditions from time to time.

 

The version applicable to a ticket purchase will normally be the version presented or made available to the purchaser at the time the purchase is completed, except where a later change is required by law or relates to venue safety and security.

 

23.⁠ ⁠Contact

 

Questions regarding tickets, exchanges, cancellations or these Terms and Conditions should be submitted through Toy Room Club Malta’s official contact channels.

 

Guests may be asked to provide:

 

their full name;

email address;

telephone number;

order or booking number;

event name and date;

ticket details; and

any relevant supporting information.

 

Submission of a request does not guarantee that a refund, exchange or other remedy will be approved.
